OVERVIEW

Welcome to FilaFeed. The terms "we," "us," and "our" refer to FilaFeed. FilaFeed manufactures and sells 3D printing filament and related products, and operates this store and website, including all related information, content, features, tools, products and services (the "Services"). FilaFeed is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. They include important information about your legal rights, and they cover material safety, warranty disclaimers, limitations of liability, and your responsibility for determining whether our products are suitable for your intended use.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service, our Privacy Policy, our Refund Policy, and our Shipping Policy. If you do not agree, you should not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age and at least the age of majority in your state or province of residence.

Our products are industrial materials intended for use with 3D printing equipment that reaches high temperatures and emits fumes. They are not toys and are not intended for unsupervised use by minors. If you permit a minor to use products purchased from us, you are solely responsible for their supervision and safety.

To use the Services, including browsing our store or purchasing products, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR PRODUCTS AND SPECIFICATIONS

2.1 Appearance and color. We make every effort to represent our products accurately. However, filament color as displayed on your screen will differ from the physical product depending on your device, display calibration, and settings

2.2 Specifications and tolerances. Diameter, roundness, ovality, tensile, thermal, and other values published on our product pages, technical data sheets, labels, and marketing materials are nominal values, typical values, or manufacturing targets. Unless a figure is expressly stated as a guaranteed minimum or maximum, it describes typical performance and is not a warranty that every meter of every spool will meet that figure. Published mechanical and thermal properties are derived from test specimens produced under controlled conditions and will not be reproduced by your printer, your slicer settings, or your part geometry.

2.3 Net weight. Stated weights refer to the net weight of filament and exclude the spool. Minor variation within normal manufacturing tolerance is expected.

2.4 Spool compatibility. Spool dimensions, core diameter, and hub geometry are published on each product page. It is your responsibility to confirm compatibility with your printer, dry box, automatic material system, or spool holder before ordering. Incompatibility with your equipment is not a product defect.

2.5 Changes. All product descriptions, formulations, and specifications are subject to change at any time at our sole discretion. We reserve the right to discontinue any product, and to limit the quantities of any product offered to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 — MATERIAL SAFETY AND PROPER USE

This section is important. Please read it in full.

3.1 Emissions and ventilation. Thermoplastic filament, including ABS, releases volatile organic compounds and ultrafine particles when melted and extruded. ABS in particular emits styrene. You must operate 3D printing equipment in a well-ventilated area, and we strongly recommend an enclosed printer with active filtration or direct exhaust to the outdoors. Do not print in occupied bedrooms, enclosed offices without ventilation, or other confined living spaces.

3.2 Temperature and equipment. Do not exceed the maximum processing temperature stated on the product label or technical data sheet if available. Exceeding stated temperatures can cause thermal decomposition and the release of hazardous fumes, and may damage your equipment. 3D printers contain hot surfaces and moving parts. Never leave a printer running unattended, and keep equipment away from children, pets, and combustible materials.

3.3 Safety Data Sheets. A Safety Data Sheet (SDS) is available for the base material for every product we sell, linked on each product page and available on request at info@filafeed.com. You are responsible for reviewing the applicable SDS before use, and — if you are a business — for making it available to anyone who handles the material and for complying with all applicable workplace health and safety requirements, including OSHA Hazard Communication obligations where they apply to you.

3.4 Storage. Filament is hygroscopic and absorbs atmospheric moisture. Store unused filament sealed with desiccant. Material damaged by improper storage is not a defect and is not covered by our Refund Policy.

3.5 California Proposition 65 Warning. ⚠️ WARNING: This product can expose you to chemicals including styrene, which is known to the State of California to cause cancer. For more information, go to www.P65Warnings.ca.gov.

3.6 Assumption of risk. You acknowledge that 3D printing involves inherent risks, including exposure to fumes and particulates, burns, fire, and mechanical injury. You assume all such risks and agree that FilaFeed is not responsible for any injury, illness, property damage, or loss resulting from your use of our products, including use that does not follow the instructions, warnings, and safety information we provide.

SECTION 4 — SUITABILITY FOR YOUR APPLICATION

4.1 You determine suitability. We sell raw material. We do not know your printer, your settings, your part geometry, your loading conditions, or your operating environment. You are solely responsible for determining whether a product is suitable for your intended application, and for testing and validating it before relying on any part produced with it. No statement by us, whether on our website, in marketing materials, in technical documentation, or in correspondence with our team, constitutes a representation that a product is fit for any particular purpose.

4.2 Restricted applications. Our products are not designed, tested, manufactured, or certified for, and you may not use them in:

  • Medical or dental devices, implants, prosthetics, or anything intended for contact with bodily tissue or fluids
  • Food, beverage, or drinking water contact
  • Aerospace, aviation, or spaceflight components
  • Automotive, motorcycle, marine, or other vehicle safety-critical or structural components
  • Life support, life safety, emergency, or fire suppression equipment
  • Firearms, firearm components, ammunition, or weapons of any kind
  • Load-bearing structural, lifting, rigging, fall-protection, or climbing applications
  • Pressure vessels or pressurized systems
  • Electrical components carrying mains voltage
  • Children's toys, pacifiers, teethers, or products subject to CPSIA children's product requirements
  • Any application where failure of a part could reasonably result in death, personal injury, or significant property damage

If you use our products in any such application, you do so entirely at your own risk and against our express instruction, and you agree to indemnify us in full as described in Section 20.

4.3 Technical support. Any printing advice, profile recommendations, temperature settings, or troubleshooting guidance we provide is offered as a courtesy and as a starting point only. It is general information, not engineering advice, and we accept no liability for results obtained from following it.

4.4 Regulatory compliance. You are responsible for ensuring that anything you manufacture using our products complies with all applicable laws, regulations, certifications, and standards in the jurisdictions where it is made, sold, or used.

SECTION 5 — ORDERS

When you place an order, you are making an offer to purchase. FilaFeed reserves the right to accept or decline any order for any reason at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted and prepared for shipment.

If we do not accept, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at the time of the order.

Returns and exchanges are governed solely by our Refund Policy [LINK].

SECTION 6 — CUSTOM, BULK, AND WHOLESALE ORDERS

6.1 Bulk orders, custom colors, custom formulations, private-label production, and made-to-order spool configurations are quoted individually and may be subject to separate written terms, which will control in the event of any conflict with these Terms.

6.2 Custom and made-to-order production is non-cancellable and non-refundable once production has begun, except where the material fails to meet the specification agreed in writing.

6.3 Custom color matching is performed to a commercially reasonable visual standard. Unless we have agreed a specific measured color tolerance in writing, exact color matching is not guaranteed.

6.4 Deposits on custom orders are non-refundable once production has begun. Lead times quoted for custom and bulk production are estimates.

6.5 Resale. You may resell products purchased from us. However, you may not: represent yourself as an authorized distributor, dealer, or partner of FilaFeed without our written agreement; repackage, relabel, or resell our products under another brand without our written consent; alter or remove our labeling, batch codes, or safety information; or make any representation, warranty, or specification claim about our products beyond what we publish. You are responsible for passing all safety information, including the SDS and the Proposition 65 warning, to your own customers.

SECTION 7 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, as set out in your order confirmation email. Unless expressly stated otherwise, posted prices exclude taxes, shipping, handling, customs, duties, and import charges.

Prices in our online store may differ from prices offered in physical stores or on third-party marketplaces where our products appear. Promotions may be governed by separate terms, and where those conflict with these Terms, the promotion terms govern.

You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update it so we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; (iii) charges you incur will be honored by your card issuer; and (iv) you will pay all charges at the posted prices, including shipping, handling, and applicable taxes.

We reserve the right to correct pricing errors and to cancel and refund any order placed at an erroneous price, including after the order has been submitted.

SECTION 8 — SHIPPING, DELIVERY, AND EXPORT

8.1 All delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, weather, customs processing, or other events outside our control.

8.2 Title and risk of loss pass to you when we transfer products to the carrier.

8.3 Damage in transit, lost packages, and packages marked delivered are handled in accordance with our Refund Policy.

8.4 International orders. You are the importer of record for any international shipment and are solely responsible for all duties, taxes, brokerage fees, and customs charges, and for ensuring the product may lawfully be imported into your country. Refused shipments or shipments abandoned at customs are not refundable beyond amounts we actually recover.

8.5 Export compliance. You agree not to export or re-export our products in violation of United States export control or sanctions laws, or to any party or destination prohibited under those laws.

SECTION 9 — INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by FilaFeed, its affiliates, or its licensors, and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants any license or right under any patent, trademark, copyright, or other intellectual property of FilaFeed, Shopify, or any third party. All rights not expressly granted are reserved.

(Note: this restriction applies to our website content and branding. It does not restrict your use of filament you have purchased, which is governed by Sections 3 through 6.)

FilaFeed's names, logos, product and service names, designs, and slogans are trademarks of FilaFeed or its affiliates or licensors, and may not be used without our prior written permission. Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, and marks appearing on the Services are the trademarks of their respective owners. References to third-party printer manufacturers, slicers, or brands are for compatibility identification only and do not imply affiliation, sponsorship, or endorsement in either direction.

SECTION 10 — OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control.

We provide access to such tools "as is" and "as available," without warranties, representations, or conditions of any kind, and without endorsement. We have no liability arising from your use of optional third-party tools. Your use of them is at your own risk, and you should review the terms on which they are provided.

We may offer new features through the Services in future. Such features form part of the Services and are subject to these Terms.

SECTION 11 — THIRD-PARTY LINKS AND PRINT PROFILES

The Services may contain materials and links to websites operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you leave the Services to access them, you do so at your own risk.

This includes any printer profiles, slicer configurations, or settings files we publish or link to for third-party software or hardware. These are provided as a convenience and as a starting point. Printer condition, firmware, and calibration vary, and we are not responsible for failed prints, wasted material, or equipment damage arising from their use.

We are not liable for any harm or damages related to your access of third-party websites or your purchase or use of third-party products or services. Complaints regarding third-party products and services should be directed to the third party.

SECTION 12 — RELATIONSHIP WITH SHOPIFY

FilaFeed is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with FilaFeed. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and FilaFeed, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with FilaFeed.

SECTION 13 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

SECTION 14 — REVIEWS, PHOTOS, AND FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, photographs of printed parts, proposals, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use and marketing.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback, including rights to any model, design, or artwork depicted; (ii) you have disclosed any compensation, free product, or other incentive received in connection with your submission, as required by FTC guidance; and (iii) your Feedback complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not obligated to, monitor, edit, or remove Feedback we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes any party's rights or violates these Terms.

Your Feedback must not violate any third-party right, contain unlawful or abusive material, or contain malware. You may not use a false email address or misrepresent your identity or the origin of Feedback. You are solely responsible for your Feedback and its accuracy.

SECTION 15 — ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders at any time without prior notice, including after you have submitted your order.

SECTION 16 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, state, or local law, rule, or ordinance; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, disparage, or intimidate our employees or any other person; (e) to transmit false or misleading information; (f) to send, receive, upload, download, or re-use any material that does not comply with these Terms; (g) to transmit unsolicited advertising or spam; (h) to impersonate any person or entity; or (i) to engage in conduct that restricts anyone's use of the Services or that may harm FilaFeed, Shopify, or users of the Services, or expose them to liability.

You further agree not to: (a) upload or transmit malicious code; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraper, data extraction tool, automated device or process, or AI tool (including agentic AI) to access the Services; or (f) interfere with, bypass, or circumvent security or authorization features, robot exclusion headers, or other access-restriction measures.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 17 — AGENTS

17.1 This section (the "Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on behalf of or using a person's device without direct supervision.

17.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates at all times in strict accordance with Section 17.4. No Agent may access the Services if we have requested that it refrain from doing so.

17.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.

17.4 Agents must: (i) identify in all HTTP/HTTPS requests that the request is from an Agent, and disclose the Agent's name in the user agent string in the form "Agent/[agent name]"; (ii) not conceal or obfuscate that access is from an Agent, including by mimicking human behavior and interaction patterns, or by completing or circumventing CAPTCHAs or similar measures; (iii) respond truthfully to any question or prompt seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit, modify, or control how Agents access the Services.

SECTION 18 — DISCLAIMER OF WARRANTIES

Information presented through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness, or usefulness. Any reliance you place on it is strictly at your own risk.

EXCEPT AS EXPRESSLY STATED IN WRITING BY FILAFEED, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT OUR PRODUCTS WILL PERFORM AS YOU EXPECT ON YOUR EQUIPMENT, WITH YOUR SETTINGS, OR IN YOUR APPLICATION, OR THAT ANY PART PRODUCED USING OUR PRODUCTS WILL POSSESS ANY PARTICULAR STRENGTH, DIMENSIONAL ACCURACY, THERMAL RESISTANCE, APPEARANCE, OR DURABILITY.

Our sole quality commitment is set out in our Refund Policy, and any remedy under it is limited to replacement or refund of the affected product at our election.

SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU IN FULL.

SECTION 19 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL FILAFEED, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND — INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, WASTED MATERIAL, PRINTER OR EQUIPMENT DAMAGE, PRINTER DOWNTIME, COST OF REPRINTING OR REWORK, COST OF SUBSTITUTE GOODS, OR REPLACEMENT COSTS — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO FILAFEED FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

SECTION 20 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FilaFeed, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party arising out of:

  1. your breach of these Terms of Service or the documents incorporated by reference;
  2. your violation of any law or the rights of a third party;
  3. your access to and use of the Services;
  4. your use of our products in any application listed in Section 4.2, or in any application for which you have not independently validated their suitability;
  5. any part, product, or component you manufacture, distribute, or sell using our products, including any claim of defect, injury, property damage, or regulatory non-compliance relating to it; and
  6. your failure to follow the safety information in Section 3 or in any applicable Safety Data Sheet, or to pass that information on to any person to whom you resell or supply our products.

We will notify you of any indemnifiable claim, provided that failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such a claim at your expense, including choice of counsel, but will not settle a claim imposing non-monetary obligations on you without your consent, which will not be unreasonably withheld. You will cooperate in the defense of indemnified claims.

SECTION 21 — TERMINATION

We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion at any time and without notice. You will remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Material Safety and Proper Use, Suitability for Your Application, Intellectual Property, Reviews/Photos and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Dispute Resolution, and any other provision that by its nature should survive.

SECTION 22 — GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service and any separate agreements under which we provide Services are governed by the laws of the State of Texas, without regard to its conflict of law provisions. You and FilaFeed consent to the exclusive venue and personal jurisdiction of the state and federal courts located in Harris County, Texas.

SECTION 23 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. Such a determination does not affect the validity or enforceability of the remaining provisions.

SECTION 24 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies posted on this site, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, including any prior versions of these Terms.

Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 25 — ASSIGNMENT

You may not delegate, transfer, or assign this agreement or any of your rights or obligations under it without our prior written consent, and any attempt to do so is null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice to you.

SECTION 26 — FORCE MAJEURE

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, severe weather, hurricanes, flooding, power or utility failures, grid instability, raw material or resin shortages, supplier failures, labor disputes, carrier disruption, equipment failure, epidemic, war, terrorism, civil unrest, or governmental action.

SECTION 27 — HEADINGS

Headings are included for convenience only and do not limit or otherwise affect these Terms.

SECTION 28 — CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check periodically for changes. We will notify you of material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
